Security Deposit and Rental Agreement

  • 1) Fill out the Rental & Security Deposit Agreement and email to casamariposamexico@gmail.com . Please send a wire transfer for the first half of your rental to the address below to confirm your reservation.
    2) The balance rental amount is due 1 month prior to arrival. Please view terms for payment details.
  • By signing below, you acknowledge and agree to all of the terms and conditions contained in this agreement. It is clear that in signing this agreement, the dates and the rates have already been agreed to in prior emails.

Rental Policies

  • Reservations require a 50% RENTAL DEPOSIT at the time of booking for confirmation. The BALANCE of RENTAL must be received within 30 DAYS prior to the arrival date. Failure to pay RENTAL DEPOSIT, SECURITY DEPOSIT or balance of RENTAL on time would result in loss of the reservation and the forfeiture of all deposits paid. If reservations are made less than 60 days before arrival, then 100% of RENTAL is required at the time of booking. In the event of a cancellation no part of the deposit is refundable. Cancellations will be rebooked for a later date.
  • Reservations for the Christmas and New Year’s holidays require payment in full within 7 days of booking for confirmation, and are subject to the loss of 100% of the total rental amount regardless of time of cancellation. For additional guests (above 2 guests per room) there is an additional $500.00 charge for each person above 9 years ($250 if 9 years or under).
  • *We require all guests to put up a security deposit equal to 20% of the total rent due upon arrival to ensure the condition of the villa and its contents. Upon check out, a thorough inventory will be taken. Provided there is no more than reasonable clean up and nothing damaged or missing, security deposits will be returned. There will be no deduction made for normal wear and tear. Guests are solely liable and responsible for the breakage, damage or loss of any improvements, furniture, fixtures, equipment, and all personal property located within the rental unit caused by them or anyone they allow within the rental unit. All damage to any improvements, fixtures, furniture, equipment, or other items in the rental unit or any items that are lost will be deducted from the security deposit at full replacement cost plus all labor fees and costs, all shipping fees and costs, and all other costs, fees, and expenses necessary to fully replace the damaged or lost item. It is further understood that smoking inside the villa or exceeding the maximum occupancy will forfeit the security deposit.
  • In the event any guests damage or lose any item within the rental unit and then threaten to provide an adverse report or provide an adverse report to either VBRO or Homesaway in an attempt to avoid a deduction of the replacement cost from the security deposit will forfeit the entire security deposit.
  • The maximum occupancy of the villa is as agreed in this rental agreement. Exceeding this limit will automatically forfeit the security deposit. Couches and cushions are to be protected, and not to be used as beds.
  • Only registered guests are allowed inside the villa and on the premises. The presence of any unregistered guests will result in the automatic forfeiture of amounts previously paid and the security deposit and immediate dismissal from the premises. Any changes to the list of registered guests must be made with the booking agent prior to arrival at the villa as the property administrator is not authorized to approve such changes.
  • For Weddings or other Special Events that will involve atypical traffic within the villa, traffic between multiple villas, and/or bringing in outside services such as caterers, bartenders, cooks, musicians etc. please contact us with details of your event and we will determine whether or not additional fees apply.
  • Violent, drunken, or abusive behavior toward our staff or administrators will not be tolerated. If any guest demonstrates this behavior, the entire group will be immediately evicted from the premises by the landlord’s personnel and will result in the automatic forfeiture of all amounts paid and the security deposit. No refunds will be given to guests who are dismissed under these circumstances.
  • There is absolutely no smoking within the apartment. Smoking within the apartment will automatically forfeit the security deposit.
  • Check in is after 3:00 P.M. and check out is before 9:30 A.M, or within to the times especially made with our greeter.
  • There is a $75 charge for lost apartment keys to replace the locks on the doors.
  • Please do not reprogram the satellite TV system or disconnect wiring to TV, VCR or stereo. If you do and then we have to have it reprogrammed, there will be a $50 charge.
  • Even the best or newest homes occasionally malfunction and cannot be guaranteed. Please report the malfunction to our greeter manager. Problems will be corrected as soon as humanly possible. Agent, authorized personnel or repair persons may enter the premises during business hours for any purpose connected with the repair, care or maintenance of the premises. No refunds will be issued due to malfunctioning equipment or other defective conditions or due to guest dissatisfaction. If the home is put on the market for sale, the home owner reserves the right to allow the home to be shown, but only by advance appointment made with guests at least 24 hours in advance. Every effort will be made to schedule such brief showings at a time convenient to you, to respect your privacy, and not interrupt your vacation.
  • PLEASE READ CAREFULLY:We are located in a highly desirable, rapidly developing, area where there is a possibility of construction disturbance and noise. There is no requirement for developers to notify the public prior to a project starting. So while there may be no construction near the property at the time you make a booking, there is no guarantee that there will not be construction when you arrive. It is not the Owners responsibility to advise Leaseholder of construction. We cannot move guests, re-schedule, or make price adjustments due to construction. Please consider this when scheduling a visit. The rental unit is in an area where guests should expect noise both from adjoining commercial uses, from traffic in the area and from periodic construction. We cannot move guests, reschedule, or make price adjustments due to noise. Claims by guests of unsuitable construction disturbances or noise is not a ground for a guest to cancel a reservation or a booking or to receive any refund of any deposit or any other amounts paid. Guests are to carefully review information on the website of the rental property before making any reservation or booking to satisfy themselves that they can live with any construction activities or noise. No refunds of any kind will be provided for either construction disturbances or noise.
  • Please lock all doors and windows when you leave your vacation home. Please use the safes provided for your valuables, passports and money. Please do not leave money unattended. Any loss of property or damage to property during the rental period shall be the sole responsibility of the guest.
  • We recommend Travel Insurance. It can protect you from losses you may incur because of unforeseen circumstances, illness, injuries etc. You can book insurance online at: http://www.insuremytrip.com/index-7209-0-0-0.html
  • Guest agrees that once they have checked into the property, no refund will be given for early check outs. For no shows all monies will be forfeited.
  • Please read carefully:PROPERTY AVAILABILITY: In the event that the dwelling is rendered unavailable (due to any natural disasters such as hurricanes), or should the dwelling be undergoing any unexpected major repairs, the owner shall be held harmless by Guest. The Owner will make every effort to arrange alternative accommodations, but if not possible, guests will have the option of rescheduling within 12 months. Guest may purchase travel insurance which will reimburse full rental rate if reservation is cancelled.
  • The renter named in this agreement will be responsible for themselves, and all guests whether they are registered in the villa or not. The renter acknowledges that the owner and it’s employees and agents do not carry personal liability insurance and can not be held responsible regardless of fault, for any accident, loss, damage or injury suffered by the renter, members of their party or any other guests which the renter or their party have allowed access to the property, regardless if said loss is a result directly or indirectly from acts of God, danger incident to the sea, any body of water, fire, breakdown of machinery, equipment, acts of government or other authorities, de jure or de facto, wars, whether declared or not, hostilities, civil disturbances, strikes, riots, thefts, pilferage, epidemics, quarantines, custom regulations, delays or cancellations of or changes in itineraries or schedule or from acts of omission of any airline. Furthermore, the renter hereby agrees to release and hold harmless and indemnify the owner and any and all parties involved with the rental, management and reservations of the property and to release and hold harmless it's owners or representatives from any and all loss or damage to personal property or for any injury and/or death.
  • In the event of any dispute arising from this Agreement, the prevailing party shall recover all attorneys fees, court costs and expert fees and costs in addition to all relief provided by law.
  • This rental agreement is entered into in New York City and requires performance in New York, New York. In the event of any legal or equitable proceeding to enforce, interpret or invalidate any term or provision of this agreement, the parties expressly agree that jurisdiction and venue shall lie only in the Superior Court located in New York, New York. This is a material provision of this Agreement.
  • New York law shall govern all terms of this Agreement.
